Esta obra ofrece una lectura de la evoluci\u00f3n del derecho penal desde la \u00f3ptica de la teor\u00eda de medios y el an\u00e1lisis sociocultural. Examina el modo en que la sucesi\u00f3n de las diferentes constelaciones medi\u00e1ticas, de la oralidad a las redes digitales, ha ido moldeando las pr\u00e1cticas y el concepto mismo de justicia. Adem\u00e1s, sostiene que buena parte de las crisis del derecho penal contempor\u00e1neo est\u00e1n conectadas a la influencia de los medios audiovisuales en nuestra imaginaci\u00f3n penal. Fen\u00f3menos como el punitivismo, el deterioro de la discusi\u00f3n pol\u00edtico-criminal, el auge de la estigmatizaci\u00f3n digital y los juicios medi\u00e1ticos o la expansi\u00f3n de la legislaci\u00f3n simb\u00f3lica ser\u00edan, en suma, signos de un cambio cultural profundo que coloca al derecho penal en un lugar diferente al que se le asign\u00f3 hasta el cambio de siglo.<\/p>\n

#S\u00f3los\u00edess\u00ed, #jueces, #C\u00f3digopenal, #malversaci\u00f3n, #sedici\u00f3n, #puigdemont, #irenemontero, todas estas palabras fueron tendencia del 11 al 17 de noviembre de 2023; #lamanada, #seacab\u00f3, #rubiales, #amnist\u00eda o #lawfare lo fueron antes o despu\u00e9s de aquella fecha; y muchas otras m\u00e1s lo ser\u00e1n en el futuro. Lo que une a todas ellas es el hacer referencia directa o indirecta al Derecho y a la justicia penal, que en la \u00faltima d\u00e9cada se ha convertido en uno de los temas de discusi\u00f3n m\u00e1s habituales en la red social X, antes denominada Twitter. Pero \u00bfc\u00f3mo se comunica acerca de la ley y de la justicia penal en esta red social? \u00bfQui\u00e9n y c\u00f3mo lo hacen, y en qu\u00e9 es distinto el debate formal y material al que tiene lugar en otros \u00e1mbitos? \u00bfHay una polarizaci\u00f3n sobre las cuestiones penales en este \u00e1mbito? \u00bfHay discusi\u00f3n dogm\u00e1tica o pura gresca pol\u00edtica? \u00bfQu\u00e9 es lo que se dice sobre el Derecho penal, acerca de su creaci\u00f3n y de su aplicaci\u00f3n por parte de los tribunales por gran parte de los usuarios de esta red social?<\/span><\/p>\n

La obra analiza c\u00f3mo una parte de la ciudadan\u00eda, especialmente la poblaci\u00f3n penitenciaria, comprende el delito y la pena. Examina la recepci\u00f3n del mensaje punitivo en un sentido amplio, atendiendo tanto al hecho delictivo como a la consecuencia jur\u00eddica, y centr\u00e1ndose en quienes son los destinatarios directos de la norma penal.<\/p>\n

El libro presenta una primera aproximaci\u00f3n a esta recepci\u00f3n desde tres \u00e1ngulos: la valoraci\u00f3n de la pena por quienes la cumplen, la percepci\u00f3n que tienen sobre otras sanciones previstas en el C\u00f3digo penal y la comprensi\u00f3n de los mensajes que transmiten el tipo penal y la pena entendidos como actos comunicativos. No pretende generalizar sus resultados a toda la poblaci\u00f3n penitenciaria, sino destacar la importancia de escuchar c\u00f3mo interpretan los propios destinatarios los mensajes normativos.<\/p>\n
